1. Agreement to Terms

By accessing our website at haveyachtsclub.com or booking any of our yacht charter services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Charter Services

Have Yachts Club, LLC provides private pontoon charter services on the waters of Washington, D.C. Our charters include:

• A licensed, professional captain
• Private pontoon boat for up to 6 guests
• Sound system and basic amenities
• Cooler with ice

This is a private, intimate experience for up to 6 guests. For safety and comfort, guest capacity is limited and may be adjusted based on total weight and conditions. The captain reserves the right to make final determinations.

Charter times and routes are determined by the captain based on weather, water conditions, and safety considerations. The captain has final authority over all navigation and safety decisions.

3. Booking and Payment

Reservations

• All bookings are subject to availability
• Charters must be booked at least 3 days in advance of the desired date
• Bookings may be made up to 60 days in advance
• A minimum 50% deposit is required to confirm your booking
• Remaining balance is due before boarding
• Prices are subject to change without notice for future bookings

Payment

• We accept all major credit cards through our secure payment processor (Stripe)
• All payments are in US dollars
• Your payment information is processed securely and never stored on our servers

4. Cancellation and Refund Policy

Customer Cancellations

• 7+ days before charter: Full refund minus a $50 processing fee, OR reschedule at no cost
• 3-6 days before charter: 50% refund, OR reschedule credit
• Less than 72 hours: No refund
• No-shows: No refund

Weather Policy

Light rain does not typically result in cancellation. The captain has final authority on all weather-related decisions. We recommend bringing appropriate attire for changing conditions.

Automatic Balance Payment

Rescheduling

• Weather cancellations: You will receive a reschedule link valid for 30 days. You may select a new date within 60 days of your original charter date at no additional cost (unless the new date has holiday pricing, in which case you pay the difference).
• Customer-initiated rescheduling: One reschedule is permitted per booking. If the new date is more expensive, you pay the difference. No refunds or credits are issued if the new date is less expensive.

5. Guest Responsibilities and Conduct

• All guests must be at least 18 years old or accompanied by a parent/guardian
• Valid photo ID is required for all guests
• Maximum capacity is 6 guests - no exceptions
• Guests must follow all instructions from the captain
• No illegal substances permitted on board
• Smoking is not permitted on the vessel
• Guests are responsible for their personal belongings
• Any damage to the vessel caused by guests will be charged accordingly

For safety and comfort, guest capacity is limited and may be adjusted based on total weight and conditions. The captain reserves the right to make final determinations.

BYOB Policy

You are welcome to bring your own beverages (BYOB) including alcohol for guests 21+. Please drink responsibly. The captain reserves the right to refuse service to intoxicated individuals or end the charter early if guest behavior becomes unsafe or disruptive. No refunds will be issued in such cases.

6. Arrival and Departure

• Please arrive 15 minutes before your scheduled departure time
• Late arrivals do not extend your charter time
• If you are more than 30 minutes late without notice, we may cancel your charter as a no-show

7. SMS Communications

By providing your phone number during booking, you consent to receive transactional SMS messages including booking confirmations, reminders, and updates.

8. Assumption of Risk and Liability Waiver

Boating activities involve inherent risks including but not limited to: drowning, injury from falls, collision, weather conditions, and other hazards. By booking a charter, you acknowledge these risks and agree that:

• You voluntarily assume all risks associated with the charter
• You release Have Yachts Club, LLC, its owners, employees, and captain from liability for any injury, loss, or damage except those caused by gross negligence
• You confirm that all guests can swim or will wear provided life jackets
• You will inform the captain of any medical conditions that may affect safety

All guests may be required to sign a liability waiver before boarding.

9. Limitation of Liability

To the maximum extent permitted by law, Have Yachts Club, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of our services.

Our total liability shall not exceed the amount you paid for the charter service.

10. Intellectual Property

The content on our website, including text, graphics, logos, and images, is the property of Have Yachts Club, LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of the District of Columbia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modified terms.
